TERMS AND CONDITIONS
1. Identification of the Operating Entity
The operation of Alto do Forte – Apartamentos Turísticos is managed by:

2. Purpose
These Terms and Conditions govern the provision of tourist accommodation services at Alto do Forte – Apartamentos Turísticos, as well as the rights and obligations between JDS – Promoção Turística, Sociedade Unipessoal, Lda and the Guest.
Upon confirmation of the reservation, an accommodation contract shall be deemed concluded between the parties under the terms set forth herein.
3. Reservations
All rates are presented in Euros (€).
When making a reservation, the Guest must provide:
- Number of guests
- Dates of stay
- Telephone contact
- Email address
- Special requests (if applicable)
Online reservations will be confirmed by email.
The company is not responsible for errors in the email address provided by the Guest or for failure to receive confirmation. If confirmation is not received, the Guest must contact the operating entity.
4. Payments
The following payment methods are accepted:
- Bank transfer
- CE Maestro
- Visa Electron
- Visa and MasterCard credit cards
Full or partial payment shall be made under the conditions indicated at the time of booking.
5. Cancellation and Rescheduling Policy
Payment and cancellation conditions vary depending on the season, as detailed below.
5.1 Low and Mid Season
(October 1st to April 30th)
- Payment must be made up to 7 (seven) days prior to the check-in date.
- Cancellations made up to 7 (seven) days before the check-in date are eligible for a 100% refund of the amount paid.
- Cancellations made within the 7 (seven) days prior to check-in will result in retention of 50% of the total reservation amount.
If payment is not made within the stated deadline, the reservation may be automatically cancelled.
5.2 High Season / Summer
(May 1st to September 30th)
- A payment of 50% of the total reservation amount is required at the time of booking in order to guarantee the reservation.
- The remaining 50% must be paid up to 7 (seven) days prior to the check-in date.
- Cancellations made up to 7 (seven) days before the check-in date are eligible for a 100% refund of the amount paid.
- Cancellations made within the 7 (seven) days prior to check-in will result in retention of 50% of the total reservation amount.
If the remaining balance is not paid within the stated deadline, the reservation may be automatically cancelled.
5.3 No-Show
Failure to arrive on the check-in date without prior communication will result in the retention of 100% of the total reservation amount.
5.4 Rescheduling
Rescheduling requests must be submitted in writing and are subject to availability and possible rate adjustments.
5.5 Force Majeure
In duly documented cases of force majeure, JDS – Promoção Turística, Sociedade Unipessoal, Lda reserves the right to assess each situation on an exceptional basis.
6. Check-in and Check-out
Check-in: from 3:00 PM
Check-out: until 11:00 AM
Late check-out requests are subject to availability and may incur additional charges.
7. Use of the Apartment
Only the persons listed in the reservation may occupy the apartment.
The Guest agrees to:
- Use the apartment with due care and diligence
- Respect the internal rules of the accommodation
- Avoid excessive noise
- Respect other guests
The following are strictly prohibited:
- Smoking inside the premises
- Bringing animals (unless expressly authorized in writing)
- Using the apartment for unlawful purposes
Non-compliance may result in immediate termination of the contract without refund.
8. Damages
The Guest shall be responsible for any damage caused to the property, furniture, or equipment during the stay. The corresponding costs may be charged accordingly.
9. Liability
JDS – Promoção Turística, Sociedade Unipessoal, Lda shall not be held liable for:
- Theft, loss, or deterioration of valuables
- Items left inside the apartment or in parked vehicles
- Damages resulting from improper use of the facilities
The company and its staff may access the apartment during the stay for cleaning, maintenance, repairs, or emergency situations.
10. Municipal Tourist Tax
Where applicable, a Municipal Tourist Tax will be charged in accordance with the regulations of the municipality of Ponta Delgada, in the amount of two euros per person per night, up to a maximum of three nights.
11. Data Protection
Personal data provided by the Guest will be processed in accordance with applicable legislation, namely the General Data Protection Regulation (GDPR).
Data will be used for:
- Reservation management
- Compliance with legal obligations
- Communication with the Guest

12. Complaints Book
In accordance with Portuguese law, a physical Complaints Book is available at the establishment.

13. Applicable Law and Jurisdiction
These Terms and Conditions are governed by Portuguese law.
